STIMOLANTI Privacy Policy

This Privacy Policy (the “Policy”) governs the privacy practices of 13420965 Canada Inc. doing business as “STIMOLANTI” with respect to personal information that you voluntarily share with us in connection with your visit to the “Site”.

If you are an entity other than a natural person, the natural person visiting or using our “Site” must have the authority to bind the entity. In this context, the terms “User”, “you” and “your” refer to both the entity and each natural person authorized to visit or use our “Site” on behalf of that entity (hereinafter a “User”) of the “Site” www.dosestimolanti.ca (hereinafter the “Site”). The policy describes the ways in which your personal information is collected, used, shared and protected when you visit or make a purchase from our “Site” as a “User”.

FOR GREATER CERTAINTY, YOUR ACCESS, BROWSING OR USE OF THE “SITE” AND THE PURCHASE OF OUR COFFEE SHALL BE DEEMED TO CONSTITUTE YOUR ACCEPTANCE OF THIS PRIVACY POLICY INCLUDING THE TERMS AND CONDITIONS OF USE.

Collecting personal information

When you visit the “Site”, we automatically collect certain information about your device, including information about your web browser, your IP address, your time zone and certain cookies, which are installed on your device. In addition, when you browse the “Site”, we collect information about the individual web pages or products you visit, the web sites or search terms that brought you to the “Site”, and information about how you interact with the “Site”. We refer to this automatically collected information as “Device Information”.

We collect Device Information using the following technologies:

Collection by cookies

Our “Site” uses cookies, which enable us to provide you with services and content that are compatible with your needs and your navigation system. Some Cookies have multiple functions and can simultaneously identify, locate and profile you. Personal information may also be collected through the use of cookies.

Cookies are files installed on your computer by the websites you visit. They enable an exchange of data between your computer and the websites you visit.

Cookies are used, among other things, to recognize certain information that has been provided by the “User” of the “Site” by a server of the “Site”. Some of these cookies will communicate personal information outside Quebec.

You can refuse cookies in the pop-up window when you arrive at our “Site”. However, your refusal to accept cookies may impair or limit your access to certain features of our “Site” and thus reduce your ability to access certain parts or content of the “Site”.

_session_id, unique session identifier, allows Shopify to store information about your session (referrer, landing page, etc.).

_shopify_visit, no data retained, persists for 30 minutes since the last visit. Used by our web “Site” provider's internal statistics tracking system to record the number of visits.

_shopify_uniq, no data retained, expires at midnight (depending on visitor location) the following day. Calculates the number of visits to a store per unique customer.

_cart, unique identifier, persists for 2 weeks, stores your “shopping cart” information.

_secure_session_id, unique session identifier

_storefront_digest, unique identifier, undefined if the store has a password, used to determine whether the current visitor has access.

Log files” track ‘Site’ activity and collect data such as your IP address, the type of browser you use, your Internet service provider, your referring and exit pages, and your timestamp data (date and time).

Web beacons”, ‘tags’ and ‘pixels’ are electronic files that record information about how you browse the ‘Site’.

In addition, when you make or attempt to make a purchase through the “Site”, we collect certain information about you, including your name, billing address, shipping address, payment information including credit card numbers, e-mail address and telephone number.  This automatically collected information is referred to as “Order Information”.

When we use the term “Personal Information” in this Privacy Policy, we are referring to both Device Information and Order Information.

Changing cookie settings

You can manage the processing of your personal information by cookies by modifying your browser settings. For more information about changing your browser settings, you can refer to the information provided by your browser. Use of your personal information

Generally, we use the Order Information we collect to process any order placed through the “Site” including to (i) process your payment information, (ii) arrange for shipment of your order and (iii) provide you with invoices and/or (iv) order confirmations. In addition, we use such Order Information to (v) interact with you, (vi) evaluate potential fraud or risk, (vii) protect your rights and those of STIMOLANTI, (viii) meet legal requirements and where it corresponds to the preferences you have communicated to us, (viiii) provide you with information or advertisements about our products via email and/or SMS.

Any entity other than a natural person, the natural person who visits or uses our “Site” in this context, the “User”, consents to the collection, use and disclosure of his or her personal information for the purposes and to the entities described above.

You acknowledge and agree that any personal information associated with payment for a payment and which may be so captured and stored on the secure transaction system of the secure payment platform provider will then be held by the secure payment platform provider and not by STIMOLANTI.

In addition, when you visit the “Site” or order our coffee, you consent to STIMOLANTI using as an individual (i) your first name and first letter of your last name, as an entity (ii) your organization name (iii) your comments for promotional purposes via social networks. You may withdraw all or part of your consent at any time. To do so, please notify us in writing at dose@stimolanti.ca.

We use the Device Information (in particular your IP address) that we collect to evaluate potential fraud or risks and, more generally, to improve and optimize our “Site” (for example, by generating analyses of how our customers browse and interact with the “Site”, and to evaluate the success of our advertising and marketing campaigns).

Sharing your personal information

We share your Personal Information with third parties who assist us in using it for the purposes described above. As mentioned above, STIMOLANTI may share your personal information with the above-mentioned third parties operating outside Quebec. To this end, STIMOLANTI conducts a privacy impact assessment with each of these third parties and ensures at all times that when your information is communicated outside of Quebec, it benefits from adequate protection, particularly with respect to generally accepted privacy principles. Consequently, your personal information will sometimes be communicated outside Quebec.

Finally, we may also share your Personal Information to comply with applicable laws and regulations, respond to a subpoena, search warrant or other lawful request for information we receive, or to protect our rights.

Behavioral advertising

As mentioned above, we use your Personal Information to provide you with tailored advertising or marketing messages that we think may be of interest to you. Third-party links included on the “Site” are provided as a convenience to you, and the inclusion of any link does not imply a recommendation or endorsement by us of such web site or the products or services offered therein. IF YOU DECIDE TO ACCESS ANY OF THE THIRD-PARTY WEBSITES, YOU DO SO ENTIRELY AT YOUR OWN RISK. Any third-party content, data or publications made available via the “Site” are provided by us as is for your convenience and information. STIMOLANTI MAKES NO WARRANTY AND SHALL NOT BE LIABLE FOR (i) THE VALIDITY OF CONTENT, PRODUCTS AND SERVICES OFFERED ON THIRD PARTY WEB SITES; (ii) THE CONTAMINATION BY COMPUTER VIRUSES ATTRIBUTABLE TO THE USE OF THIRD-PARTY WEB SITES; OR (iii) THE COLLECTION OF YOUR PERSONAL INFORMATION AND ITS USE AND DISCLOSURE ON THIRD PARTY WEB SITES.

Data retention

When you place an order through the “Site”, we keep your Order Information on file, unless and until you ask us to delete it. To do so, please notify us in writing at dose@stimolanti.ca.

Access and restrictions

You must be at least eighteen (18) years of age, and/or have parental consent, to visit or use our “Site” and to purchase our coffee. By accessing or using this “Site”, you represent that you are at least eighteen (18) years of age, and/or have parental consent, and are able to provide us with such proof in writing upon request. We will not be liable for any misrepresentation of your age.

We assume no responsibility under the laws applicable to your location outside Quebec governing access to our “Site” and the consumption of our coffee. We provide our “Site” and our coffee in accordance with Quebec law and regulations. Should you suffer any loss, damage or other inconvenience as a result of consuming our coffee, please be advised that we disclaim all liability under laws applicable outside Quebec.

We reserve the right to terminate your customer account, which is created solely for internal administrative purposes at STIMOLANTI, if your use of the “Site” or consumption of our coffee is in violation of this Privacy Policy including the Terms and Conditions of Use.

Privacy Policy revisions

We may update or revise our Privacy Policy from time to time to reflect, for example, changes in our practices or for other operational, legal or regulatory reasons.

Such changes shall be effective immediately upon posting on the “Site” and shall apply to any subsequent access to or use of the “Site” and consumption of our coffee. You agree to review this Privacy Policy periodically to be aware of such changes. YOUR CONTINUED USE OF THE “SITE” OR CONSUMPTION OF OUR COFFEE FOLLOWING THE POSTING OF CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES MADE HEREIN. The date of the last update is indicated in the title at the beginning of the Privacy Policy. We reserve the right to send you an e-mail or post a pop-up notice on this “Site” if changes are made to this Privacy Policy.

New purposes (if applicable)

We will notify you and ensure that we obtain any necessary consent to collect, use or disclose for any purposes other than those listed above, if applicable.

Protection of personal information

STIMOLANTI adopts physical, technological and administrative safeguards to protect your personal information and reduce the risk of unauthorized and/or unlawful access, use, disclosure and destruction.

We ensure that members of our organization who have access to your personal information are adequately trained and vigilant with respect to privacy and the protection of personal information, and we provide them with a number of training programs to ensure that this level of vigilance is maintained.

 We consciously limit the personal information we collect.

We maintain a privacy incident log in accordance with applicable legislation. In the event of a privacy incident that presents a risk of serious harm to you, we will take the necessary steps to notify you, in accordance with applicable legislation.

Privacy policy Officer

Although the law may prevent us from accepting an access request for various reasons, it does give you the right to access, rectify and withdraw your consent.

We have a legal obligation to respond favorably or unfavorably to any request for access or rectification within 30 days of receiving your request and confirming your identity. We will always inform you of the consequences of your choice before accepting your request to withdraw consent.
